TERMS AND CONDITIONS OF END USERS

The following terms and conditions (referred to as ‘Agreement’) are binding upon all users (hereinafter referred to as ‘Members’) accessing and/or utilizing the services provided on the Expert Platform, including but not limited to online advice and professional consulting services, available at Sitare Mobile Application, as well as any other Business-to-Business (B2B) solutions and mobile applications operated by Sitare Pvt. Ltd.

The Mobile Application, Sitare, is presently owned and operated by Sitare Pvt. Ltd., referred to herein as ‘Sitare’.
You are considered a ‘User’ upon registering on the Expert Platform and/or the App, provided your application is accepted. This Agreement governs your access and/or use of the Expert Platform irrespective of its availability location. Additionally, while the Expert Platform is accessible through the App, it may also be available through other channels. Sitare shall not be held responsible or liable for any terms, conditions, policies, actions, omissions, etc., of any third parties involved.

1. Registration and Eligibility
By utilizing the Expert Platform, you affirm that you are at least 18 years old and possess the legal capacity to enter into a binding contract. The App bears no responsibility for any misuse of its services, including by minors. However, you may inquire about minors in your family in accordance with the terms and conditions outlined herein.
The App and its services are intended solely for personal and entertainment purposes. Information provided on the Appshould not be construed as professional advice or guidance.
You are accountable for safeguarding the confidentiality of your account credentials and for all activities conducted under your account. Prompt notification of any unauthorized account usage is required.

2. User Consent
By accessing and utilizing the App, you (‘Member’) acknowledge that you comprehend the terms and unconditionally and expressly consent to the Terms of Usage of this App. If you disagree with the Terms of Usage, please refrain from clicking on the ‘I AGREE’ button. It is advised that the User thoroughly reads the Terms of Usage before utilizing or registering on the App or accessing any material, information, or services through it. Your use and continued usage of the App (regardless of any amendments made periodically) shall indicate your acceptance of the terms of usage and your agreement to be legally bound by them.

3. Terms Of Usage
You agree to refrain from disturbing, manipulating, or sabotaging the integrity of the feedback rating system on our App and application. Sitare reserves the right to remove older ratings or exclude certain ratings without prior notice if it believes they compromise the integrity of the rating system. You will not disrupt or interfere with the servers, networks, or equipment associated with Sitare.
You agree not to attempt to gain unauthorized access to any computer system or network connected to Sitare. You will not utilize the App for any illegal purposes.
You agree not to post, email, upload, transmit, or otherwise make available through the Sitare platform any: (a) junk mail, spam, or unsolicited email; (b) abusive, vulgar, threatening, defamatory, libelous, unlawful, racist, obscene, or otherwise objectionable material; (c) material that breaches or attempts to breach any third-party rights, including privacy and intellectual property rights; (d) material that encourages or constitutes civil wrongs, criminal offenses, or attempts to violate applicable laws.
You will not attempt to breach relevant rules, laws, regulations, or ethical codes.
You agree to comply with all applicable domestic and international laws, statutes, ordinances, and regulations regarding your use of Sitare Services.
Sitare may facilitate file transfers between members and Astrologers. You are solely responsible for scanning such files using antivirus software before opening them on your system or device.
You will not impersonate any person or entity or provide false information about your employment or association with any person or entity.
You will not threaten, harass, stalk, or violate the privacy of any other member or Astrologer.
You will refrain from using abusive or offensive language on the App or when interacting with our Astrologers in any manner, including but not limited to chats, calls, messages, and forums. Violation of this provision may result in the termination of your Sitare Account and seizure of funds in your Sitare wallet.
Sitare reserves the right to review members personal profiles and correct or amend any spelling or typing errors. Under its sole discretion, Sitare may (a) refuse to communicate or post, or (b) remove or delete any content uploaded by a Member.

4. Disclaimers
Sitare is not responsible for any incorrect or inaccurate content posted on the Website or in connection with the Service, whether caused byusers of the Website, Astrologer Service Providers or by any of the equipment or programming associated with or utilized in the Service.
Sitare assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications linefailure, theft or destruction or unauthorized access to, or alteration of communications.
Sitare is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers orproviders, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at anyWebsite or combination thereof, including injury or damage to users and/or Astrologer or to any other person's computer related to or resulting fromparticipating or downloading materials in connection with the Web and/or in connection with the Service. Under no circumstances will Sitare or any of its affiliates, advertisers, promoters or distribution partners be responsible for any loss or damage,including personal injury or death, resulting from anyone's use of the App or the Service, any Content posted on the App or transmitted toAstrologer , or any interactions between users of the App, whether online or offline.
Any information may be posted on the Sitare for informational purposes only and is not intended to replace or substitute for anyprofessional financial, medical, legal, or other advice. Sitare makes no representations or warranties and expressly disclaims any and all liability concerning any treatment, action by, or effecton any person following the information offered or provided within or through the App.
If any user of the App has specific concerns or a situation arises in which he requires professional or medical advice, he should consult with anappropriately trained and qualified specialist. Specializing in providing Astrological predictions and readings based on users questions and birth details, the guidance/predictions provided via ‘Sitare’ service should be considered for entertainment purposes only and not as professional advice or counseling.
Sitare prohibits prediction which is unlawful/illegal or against any law. Sitare refrains from providing below mentioned list of prediction/advice, which is not exhaustive:
i. Predicting gender/sex of the unborn.
ii. Predicting on any matter/game related to gambling.
iii. Predicting on any matter which is illegal/unlawful.
iv. Predicting with regard to ensuing death for any reason whatsoever.
v. Predicting date/time for medical related issues such as an operation for successful completion.
By using the services offered by our virtual advisors/Astrologers through this app, users agree that any decisions made or actions taken based on the information provided during a session are solely their responsibility. The app developer shall not be held liable for any consequences resulting from reliance on these predictions. Please note that the app cannot guarantee accuracy or predict future events with certainty. Users must exercise their judgment when interpreting the insights gained from the ‘Sitare’ sessions.
Sitare does not hold any responsibility for recommendation, verification, review, evaluation, endorsement, or for guaranteeing the qualifications, claims, background, and competence of any Astrologer, or for any response, advice, recommendation, prediction, information, or any other service provided by any Astrologer. Sitare shall not be deemed to be the provider of any of the services given by an Astrologer or other information acquired through the services.
Member agrees and acknowledges that the Sitare chat platform is provided and hence will not be liable to chat any demand or claim against Sitare, its employees, affiliates, directors, representatives, shareholders, officers, agents, or subcontractors with respect to Sitare App or/and application. Use of the services from experts is at the member’s sole risk.
To all extent as allowed by the law, Sitare disclaims warranties of all kinds, implied or expressed, (including but not limited to) warranties of fitness for a given purpose, merchantability, security, accuracy, or non-infringement.
Sitare does not believe and shall not be responsible for: (a) the availability and accuracy of the chat platform; or (b) any damages related to chat or arising from the Astrologer’s end and/or any advice, recommendation, information, response, prediction, opinions, and/or services provided (or not provided) by an Astrologer.
Sitare does not guarantee that Sitare services will always function uninterrupted or that they will be error-free, timely, and secure at all times.

5. Intellectual Property
The content and materials available on the App, including but not limited to text, graphics, logos, images, and software, are the property of Sitare or its licensors and are protected by copyright and other intellectual property laws.
The Sitare contains the copyrighted material, trademarks, and other proprietary information.You shall not copy, publish, transmit, distribute, or sell any such proprietary information. You may access and use the content and materials on the App for personal, non-commercial purposes only. Any other use, including but not limited to reproduction, distribution, or modification, is prohibited without the prior written consent of Sitare.
Opinions, statements, or content made available through the Service by Astrologer, are those of the Astrologer, and should not necessarily be reliedupon. Under no circumstances will Sitare or its affiliates be responsible for any loss or damage resulting due tothe content posted/transmitted on the App by anybody as Sitare does not authenticate, investigate or does background check of theinformation which is uploaded on Sitare App.
All vested contingent and future intellectual property rights in Sitare including but not limited to copyright, trademark, service marks,design rights (whether registered or unregistered), patents, knowhow, trade, secrets, inventions, database rights and any applications for protection orregistration of these rights and all renewals and extensions there of existing in any part of the world whether now known or in the future shall remain with the Sitare.

6. Pricing:
The standard pricing for the services provided by the Astrologers shall be determined solely at the discretion of the Astrologers.
All discounts applicable to the standard pricing for the services provided by the Astrologers shall be determined solely at the discretion of the Astrologers. The Astrologer reserves the exclusive right to set, modify or withdraw any discounts at anytime without prior notice.

7. Disclaimer of Warranties
The App and its services are provided, without any warranties of any kind, express or implied.
Sitare does not guarantee the accuracy, completeness, or reliability of any information or content provided on the App, including but not limited to horoscope readings and astrological predictions.

8. Limitation of Liability
To the fullest extent permitted by law, Sitare shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App or its services, even if Sitare has been advised of the possibility of such damages.

9. Indemnification
You agree to indemnify and hold harmless Sitare, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys fees, arising out of or in any way related to your use of the App or violation of these Terms.

10.Modification of Terms
Sitare reserves the right to modify or discontinue these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the App.

11.Governing Law and Jurisdiction
The terms and conditions of this Agreement shall at all times be construed in accordance with Act and Regulations and applicable laws of India there under as amended from time to time.
All legal disputes are subject to the exclusive jurisdiction of courts in Mumbai only
